The above is my Bill of Costs as against the Defendant in this action.

drafted by Mr. Kingsmill and enclosed by him in his letter to Mr. Hoey of 25th April 1868, (Saturday, Night) for signature before witness.

DEAR SIRS,

Having made my arrangements to leave this for Europe for some time; now find that I am involved as defendant in an action brought against me in the Supreme Court of this Colony, and in which I am at this moment threatened with an arrest under a Copias. At the present moment I am not in a position to get the two sureties required to join in a Bond, but the Capias I am told will be withheld on certain terms-one of which is that I should give you authority to hold the sum of $10,000 to the order of the Registrar or Acting Registrar for the time being of the Supreme Court of this Colony to abide the issue of the action of KEMPNER v. HOEY; that is to meet the amount of judg ment in case the result should be against me. For the considerations above mentioned I hereby authorize and direct you to hold the above amount to the order of the Registrar or Acting Registrar of the said Supreme Court or until you shall receive notice of discharge from such order from the said Registrar or Acting Registrar, but in the meantime the interest is to be on my account. Will you kindly excuse the trouble and worry this matter may give you, but circum- stanced as I am, and as the whole matter has turned up within a few hours, have no other alternative.
